Highly Skilled Migrant Programme - Frequently Asked Questions

1) How can I obtain the guidance notes and application forms?

You can download the Highly Skilled Migrant Programme Guidelines and application form from our website www.workingintheuk.gov.uk using the 'All Forms' link on the right hand side of the homepage. Alternatively, you can request a copy to be posted to you by calling our Distribution Centre on 08705 210 224.

2) How do I know what documents to send with an application?

The HSMP Guidelines and these FAQs explain the evidence we require from you in order to qualify for points towards the scheme.

3) How do the application rules apply to those applicants who are 28 years of age and under?

If you are making an application in the under 28 category, your application must be received before your 28th birthday. Evidence of your age should be in the form of an official document, such as birth certificate, or driving license. Please do not send your passport in with your application. However, a notarised copy of the personal details page of your passport can be used as evidence of your age. Please refer to the HSMP Guidance for Applicants Under 28 Years of Age for further advice.

4) What is the fee for consideration of an application and how do I pay?

The HSMP fee is £315. Payment can be made by one of the 3 methods indicated on the payment form:

1.UK Postal Order
2.Credit/Debit card or
3.Cheque. Please make cheques payable to 'Home Office, Work Permits (UK)'.

5) Do you accept copies of certificates or other evidence?

In order to assist proper verification of evidence submitted, copies of documents will not be accepted in support of HSMP applications. HSMP Teams will not consider copied documents and will not award points claimed for evidence that is not original.

Any documentary evidence you provide, therefore, should be original. Where a document is not in English the original must be accompanied by a fully certified translation by an officially recognised translator. An officially recognised translator is defined as one that is recognised by the local British High Commission or Embassy.

There is one exception to this practice that relates to proof of age for applicants under 28 years of age. A notarised copy of the personal details page/s in the passport will be accepted as outlined in question 3 above. This concession is in place in case applicants need access to their passport for travel etc whilst their application is under consideration.

Customers should also be aware that caseworkers cannot advise on whether applications containing copied documents would meet the criteria if the original documentation were to be presented. In practice, copies of documents are not given any consideration.

6) When will my documents be returned after consideration?

The HSMP case-working Team will return your documents once the application process is complete. If you need your documents back before this time, please contact the HSMP Team. The contact details are:

This service is not currently available for HSMP applications.

11) What is the provision for Masters of Business of Administration (MBA) Graduates?

The MBA provision is part of the HSMP and aims to attract highly qualified and talented managers to the UK.

If you graduate from one of the eligible MBA programmes while that programme is on the list of eligible courses then you are eligible to apply for the MBA Provision. Like other HSMP applicants, you will also need to demonstrate that you will be able to continue your chosen career in the UK; that you intend to make the UK your main home; and that you can support yourself and any dependants without recourse to public funds.

12) Can sports people apply under HSMP?

Participants in team sports such as football who apply under HSMP to continue their playing career in the U.K. will only be considered as achieving significant achievement in their chosen sport if they are of at least the same standard of achievement required for a work permit to be issued. Advice on whether applications would meet the work permit arrangements for sports people can be sought from WP (UK) Sports and Entertainment Team, telephone 0114 274 3303.

However, it should be noted that even if you appear to qualify for a work permit this will not automatically mean that the you will gain approval under the HSMP.

13) Where do I send the completed application form?

Initial applications should NOT be sent directly to the HSMP team in Sheffield.

They must instead be sent to:

Please complete a HSMP Urgent Treatment form which can be faxed to the HSMP Team on 0114 207 6021. You can obtain a copy of this form from our website using the 'all forms' link on the right hand side of the homepage.

17) Can I continue working in the UK while my HSMP application is being processed?

You are unable to start work until you have received approval for your further leave to remain application against your Immigration Employment Document (in this case your HSMP application), unless you already have leave to enter or leave to remain in another immigration category that allows you to continue or commence full time work. If you are in any doubt, you should phone the Immigration and Nationality Enquiry Bureau on 0870 606 7766.

18) How do I notify a change of my address?

If you change your address please send full details to the HSMP Team in writing, by e-mail HSMP.workpermits@ind.homeoffice.gsi.gov.uk or by fax on 0114 207 6021.

19) How long have I got, after a successful application decision, to enter the UK?

You must apply for entry clearance at a British Embassy within your own country and within 6 months from the date of your approval letter.

20) How do I apply for an extension to an existing HSMP permission or one close to expiry?

Extension applications must be submitted no sooner than 5 weeks before your leave to remain as a Highly Skilled Migrant expires.

Please complete an FLR (IED) form, enclosing the appropriate fee (£335) and documents (see page 10 of the FLR(IED) form). Your passport and those of any dependants must be sent together with the FLR (IED) form in order to be endorsed.

21) My application for HSMP was unsuccessful, what can I do?

If you believe the decision was unfair and you wish the case to be reviewed without submitting any new evidence, you can request a review of the decision. A review request form is available on the www.workingintheuk.gov.uk website, please follow the link to 'all forms'. You should explain where you think the case should have been marked differently (please include your reference number). Your case will then be passed to a different case-worker who will independently mark it. You will not be charged for this. This request must be received within 28 days of the date of your refusal letter. A maximum of two reviews may be requested in respect of any application.

However if you wish to submit new, or additional, evidence to support your application, or if you wish to claim additional points, you must submit a new HSMP application and include the standard fee. You should submit a new application form and submit full documentary evidence to establish the points claimed, even if this evidence has been submitted with a previous application. The new application will receive a full, new consideration of all of the evidence submitted. The previous award of points will not be taken into consideration in the fresh application.
