5) Do you accept
copies of certificates or other evidence?
In order to assist proper
verification of evidence submitted, copies
of documents will not be accepted in support
of HSMP applications. HSMP Teams will not
consider copied documents and will not award
points claimed for evidence that is not original.
Any documentary evidence
you provide, therefore, should be original.
Where a document is not in English the original
must be accompanied by a fully certified translation
by an officially recognised translator. An
officially recognised translator is defined
as one that is recognised by the local British
High Commission or Embassy.
There is one exception to
this practice that relates to proof of age
for applicants under 28 years of age. A notarised
copy of the personal details page/s in the
passport will be accepted as outlined in question
3 above. This concession is in place in case
applicants need access to their passport for
travel etc whilst their application is under
consideration.
Customers should also be
aware that caseworkers cannot advise on whether
applications containing copied documents would
meet the criteria if the original documentation
were to be presented. In practice, copies
of documents are not given any consideration.
6) When will my documents
be returned after consideration?
The HSMP case-working Team
will return your documents once the application
process is complete. If you need your documents

documents can only be returned to the applicant's
current address, declared on the front of

(MBA) Graduates?
The MBA provision is part
of the HSMP and aims to attract highly qualified
and talented managers to the UK.
If you graduate from one
of the eligible MBA programmes while that
programme is on the list of eligible courses
then you are eligible to apply for the MBA
Provision. Like other HSMP applicants, you
will also need to demonstrate that you will
be able to continue your chosen career in
the UK; that you intend to make the UK your
main home; and that you can support yourself
and any dependants without recourse to public
funds.
12) Can sports people
apply under HSMP?
Participants in team sports
such as football who apply under HSMP to continue
their playing career in the U.K. will only
be considered as achieving significant achievement
in their chosen sport if they are of at least
the same standard of achievement required
for a work permit to be issued. Advice on
whether applications would meet the work permit
arrangements for sports people can be sought
from WP (UK) Sports and Entertainment Team,
telephone 0114 274 3303.
However, it should be noted
that even if you appear to qualify for a work
permit this will not automatically mean that
the you will gain approval under the HSMP.

of this form from our website using the 'all
forms' link on the right hand side of the

17) Can I continue
working in the UK while my HSMP application
is being processed?
You are unable to start work
until you have received approval for your
further leave to remain application against
your Immigration Employment Document (in this
case your HSMP application), unless you already
have leave to enter or leave to remain in

to continue or commence full time work. If

for an extension to an existing HSMP permission

your leave to remain as a Highly Skilled Migrant
expires.
Please complete an FLR (IED)
form, enclosing the appropriate fee (£335)
and documents (see page 10 of the FLR(IED)
form). Your passport and those of any dependants
must be sent together with the FLR (IED) form
in order to be endorsed.
21) My application
for HSMP was unsuccessful, what can I do?
If you believe the decision
was unfair and you wish the case to be reviewed
without submitting any new evidence, you can
request a review of the decision. A review
request form is available on the www.workingintheuk.gov.uk
website, please follow the link to 'all forms'.
You should explain where you think the case
should have been marked differently (please
include your reference number). Your case
will then be passed to a different case-worker
who will independently mark it. You will not
be charged for this. This request must be
received within 28 days of the date of your
refusal letter. A maximum of two reviews may
be requested in respect of any application.
However if you wish to submit
new, or additional, evidence to support your
application, or if you wish to claim additional
points, you must submit a new HSMP application
and include the standard fee. You should submit
a new application form and submit full documentary
evidence to establish the points claimed,
even if this evidence has been submitted with
a previous application. The new application
will receive a full, new consideration of
all of the evidence submitted. The previous
award of points will not be taken into consideration
in the fresh application.
